Scott Toomey and Dan Kain obtained a defense verdict in the Eastern District of Pennsylvania on behalf of Siemens Industry, Inc. The case arose out of finger amputation injuries sustained by Plaintiff Sean Elgert while performing routine maintenance on a telescopic conveyer located in a Philadelphia-area UPS distribution center. Plaintiff alleged that a design defect in the conveyor caused the accident and his related injuries. Siemens presented evidence at trial demonstrating that the conveyor product revolutionized UPS’ distribution operations and rendered the truck loading process both safer and more efficient. In twenty-four (24) years of use at UPS’ facilities nationwide, no similar injury ever resulted from the product. The jury returned a unanimous defense verdict finding that the product was not unreasonably dangerous and contained no design defect.
