In Rosevear v. Trans National Trading Company, Inc. et. al., Jim Ughetta, Scott Toomey and Dan Kain obtained dismissal for one of the firm’s helmet manufacturer clients. In a detailed eleven-page opinion, the Superior Court of Floyd County, Georgia held that it lacked personal jurisdiction over Shanghai Tung Kuang Light Industry Co. Ltd. under Georgia’s long-arm statute and the Due Process Clause of the United States Constitution. The Court’s opinion held inter alia that “the placement of a product into the stream of commerce, without more, is not an act purposefully directed toward the forum state."
